Terms of Service

Welcome to InexTrack, a mobile application provided by Wicare New Zealand Limited ("we," "our," or "us"). Please read these Terms of Service ("Terms") carefully before using our mobile application InexTrack and any related services (collectively, the "Service").
By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.
1. Use of the Service
1.1. Eligibility
You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.
1.2. Account Registration
To use certain features of the Service, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
1.3. Account Security
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use strong passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account.
1.4. Acceptable Use
You agree not to use the Service:
- In any way that violates any applicable law or regulation
- For the purpose of exploiting, harming, or attempting to exploit or harm minors
- To transmit any material that is defamatory, offensive, or otherwise objectionable
- To impersonate or attempt to impersonate our company, an employee, another user, or any other person
- To engage in any activity that interferes with or disrupts the Service
- To upload or share malicious code or attempt to gain unauthorized access to the Service
- Attempting to circumvent any usage limitations or restrictions imposed on your account tier (e.g., AI scan limits, image upload limits).
- Using any automated means or scripts to access the Service or scrape data, other than those officially provided or permitted by us.
2. Service Tiers, Subscriptions, and Payments
2.1. Service Tiers and Features
InexTrack is offered under different service tiers: a "Free Tier" and one or more paid subscription plans, such as a "Pro Tier" (collectively, "Paid Plans"). The specific features, usage limitations, and benefits associated with each tier are further detailed within the App and on our official website (inextrack.wicare.co.nz) and form part of these Terms.
2.2. Free Tier
Users of the Free Tier are subject to certain usage limitations, which currently include, but are not limited to:
- A monthly allowance of ten (10) AI-powered Smart Scans.
- A monthly allowance for twenty (20) Total Records Saved per month.
- Data Export functionality is disabled.
- Image Sharing and Downloading functionalities are disabled.
- Access to Reports is limited to the current calendar month, and advanced filtering or date range modification features within Reports are disabled.
- Transaction Search functionality is disabled.
- Standard email support.
These limitations are typically reset at the beginning of each calendar month. We reserve the right to modify the features and limitations of the Free Tier at any time.
2.3. Paid Plans (e.g., Pro Tier)
Users who subscribe to a Paid Plan, such as the "Personal Pro Tier" (pricing as indicated in the App or on our website at the time of purchase), will receive access to enhanced features and higher usage limits. For example, the Pro Tier currently includes, but is not limited to:
- A monthly allowance of three hundred (300) AI-powered Smart Scans.
- A monthly allowance for six hundred (600) Total Records Saved per month.
- Data Export functionality is enabled.
- Image Sharing and Downloading functionalities are enabled.
- Full access to Reports functionality, including historical data and advanced filtering.
- Transaction Search functionality is enabled.
- Priority email support.
The specific benefits and limits of any Paid Plan will be those presented to you at the time of subscription.
2.4. Fair Use Policy
For any features described as "unlimited" or for significantly high usage allowances within any plan, a Fair Use Policy applies. Your use of the Service must be consistent with typical individual or small business expense and income tracking. We reserve the right to investigate and take appropriate action, including potentially limiting or suspending access, if usage is deemed abusive, extraordinarily excessive, places an unreasonable load on our Service infrastructure, or otherwise violates these Terms or the intended use of the Service (e.g., automated bulk processing not intended for your tier, use for purposes other than receipt/expense/income tracking).
2.5. Subscriptions and Auto-Renewal
Paid subscriptions are typically billed on a recurring basis (e.g., monthly or annually). Your subscription will automatically renew for the same duration unless you cancel it or turn off auto-renewal through your respective app store account settings (Google Play Store or Apple App Store) at least 24 hours before the end of the current subscription period. You are responsible for managing your subscription and auto-renewal settings through the app store.
2.6. Payment Processing
All payments for subscriptions purchased through the App are processed by third-party payment processors associated with the app store (Google Play or Apple App Store). We do not directly collect, process, or store your full payment card information. Your payment is subject to the terms and conditions and privacy policies of the respective app store and their payment processors.
2.7. Price Changes
We reserve the right to change our subscription fees. We will provide you with reasonable prior notice of any price changes. Price changes will take effect at the start of the next subscription period following the date of the price change. By continuing to use the Service after the price change takes effect, you accept the new price, subject to app store terms.
2.8. Refunds
Except when required by law, paid subscription fees are non-refundable. Any refund requests for subscriptions purchased through an app store are subject to the refund policies of that app store (Google Play or Apple App Store). We do not have direct control over their refund processes.
3. User Content
3.1. Content Ownership
You retain all ownership rights to the content you upload to the Service, including receipts & invoices, financial data, and any other information ("User Content").
3.2. License to Use Content
By uploading User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing the Service to you.
3.3. Responsibility for Content
You are solely responsible for your User Content and the consequences of sharing it through our Service. We are not responsible for the accuracy, completeness, appropriateness, or legality of your User Content.
4. Intellectual Property
4.1. Our Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Wicare New Zealand Limited and its licensors. The Service is protected by copyright, trademark, and other laws of New Zealand and foreign countries.
4.2. License to Use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your personal or internal business expense and income tracking purposes.
5. Third-Party Services
Our Service may contain links to or integrations with third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
6. Data Export and Backup
We provide data export functionality, particularly for Pro users, to allow you to backup your financial data. We strongly recommend regularly exporting and backing up your data to protect against potential data loss.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The Service will function uninterrupted, secure, or available at any particular time or location
- Any errors or defects will be corrected
- The Service is free of viruses or other harmful components
- The results of using the Service will meet your requirements
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WICARE NEW ZEALAND LIMITED, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
9. Indemnification
You agree to defend, indemnify, and hold harmless Wicare New Zealand Limited, its directors, employees, partners, agents, suppliers, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
11. Tax and Financial Advice Disclaimer
InexTrack is designed to assist with tracking and organizing financial transactions. However, we do not provide tax, legal, or financial advice. The Service is not a substitute for professional advice from a qualified accountant, tax specialist, or financial advisor.
Features such as tax deduction flagging and GST/VAT calculations are provided as tools to assist you in organizing your financial data, but you are solely responsible for verifying the accuracy of any calculations and ensuring compliance with relevant tax laws and regulations.
12. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
